ATMEGA32L-8PU questions

The ATMEGA32L is the only avr I could use for this project since the local store doesn't have the atmega32p (16Mhz). These are questions that are bugging me right now:

1. Since Vcc is 5v, would it be ok to just use a 16MHz crystal on the ATMEGA32L and essentially "overclocking" it at that relatively "stable" voltage? I'm an experienced CPU overclocker but an MCU newb. I read a forum of people overclocking their ATMEGA8L to 16MHz from 8MHz so I was thinking it is possible.

2. If above setting works, which firmware do I flash now the one for 16MHz, right?

1. Overclocked Atmega may work or may not work.
2. All latest(encrypted) firmware versions require an Atmega with a protected bootloader.
